Terms of Service

1. Acceptance of Terms

By accessing or using any Ideas Quantified product or service, including FactCheck and WhereTo, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Description of Services

Ideas Quantified provides the following services:

2.1 FactCheck

AI-powered fact verification services through web browser extensions and mobile applications. The service analyzes content and provides accuracy assessments based on available information.

2.2 WhereTo

AI-powered location intelligence through mobile applications. The service provides information about places, neighborhoods, environmental data, and other location-based insights.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and complete information

4. Subscriptions and Auto-Renewable Payments

4.1 FactCheck Subscription Plans

• Free: $0/month (10 fact checks per month)
• Starter: $5/month or $50/year (150 fact checks per month)
• Advanced: $10/month or $100/year (300 fact checks per month)

4.2 WhereTo Subscription Plans

Free: $0/month

• All public and civic map layers: Wikipedia, political landscape, EPA Superfund and environmental data, crime, lead exposure, plant hardiness zones, air quality, data centers, and real-time weather
• Address search and place lookup
• OpenStreetMap places (restaurants, attractions, and points of interest)

Pro: $9.99/month

• Everything in Free, plus:
• Commercial data sources: Google Places suite, school ratings (SchoolDigger), daily weather forecasts (OpenWeather), historical and yearly weather (VisualCrossing), jobs search, and noise data (HowLoud)
• AI map assistant: chat and voice conversations, with a monthly usage allowance

Public map layers are free for everyone. Pro unlocks commercial data sources and AI features, which include a monthly usage allowance so pricing stays fair and sustainable.

Earlier WhereTo plans (Basic, Premium, and Professional) are no longer offered. Existing subscribers on those plans were migrated to Pro at no additional cost.

4.3 Auto-Renewal Terms

All subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

4.4 Payment Processing

• iOS Users: Payment charged to Apple ID account at confirmation of purchase
• Android Users: Payment charged to Google Play account at confirmation of purchase
• Web Users (FactCheck only): Payment processed via Stripe. WhereTo subscriptions are available exclusively through the Apple App Store and Google Play.
• Prices shown in U.S. dollars and may vary by region
• Any unused portion of a free trial period will be forfeited when purchasing a subscription

4.5 Managing Your Subscription

iOS Users:

1. Open Settings on your device
2. Tap your name at the top
3. Tap Subscriptions
4. Select the app (FactCheck or WhereTo)
5. Tap Cancel Subscription

Android Users:

1. Open Google Play Store
2. Tap Menu → Subscriptions
3. Select the app (FactCheck or WhereTo)
4. Tap Cancel Subscription

Web/Stripe Users: Open the FactCheck app or extension and tap Manage Subscription to open the secure Stripe billing portal, where you can update payment, change plans, or cancel.

4.6 Cancellation Policy

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods
• You retain access until the end of the paid period

4.7 Free Trials

We may offer free trial periods for new subscribers. You will be charged when the trial period ends unless you cancel before the trial ends. Trial terms will be clearly displayed at signup.

5. Acceptable Use

You agree not to:

• Use the services for illegal or unauthorized purposes
• Attempt to bypass usage limits or security measures
• Interfere with or disrupt the services
• Reverse engineer or attempt to extract source code
• Use the services to spread misinformation
• Share or resell access to your account
• Use automated systems to access services beyond normal app usage
• Collect or harvest data from other users

6. AI-Generated Content Disclaimer

Important: Our services use AI to analyze content and provide information. AI-generated results may contain errors or inaccuracies.

• FactCheck: Fact-check results should not be considered absolute truth and should be independently verified for critical decisions.
• WhereTo: Location data, environmental information, school and neighborhood data, and AI responses are for informational purposes only and should not be the sole basis for important decisions (e.g., home purchases, safety assessments).

We do not guarantee the accuracy, completeness, or timeliness of any information provided by our services.

7. Third-Party Data Sources (WhereTo)

WhereTo aggregates data from multiple third-party sources. Access to data sources varies by subscription tier:

We do not guarantee the accuracy of third-party data. Data may be outdated, incomplete, or contain errors. Always verify critical information through official sources.

8. Location Services (WhereTo)

WhereTo requires location access to provide location-based features:

• Location data is used only to provide the requested services
• You can use the app without location access (with reduced functionality)
• We do not sell your location data

9. Intellectual Property

The services and their original content, features, and functionality are owned by Ideas Quantified and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. User Content and Data

You retain ownership of content you submit. By submitting content, you grant us a license to:

• Process and analyze the content to provide the services
• Store content as necessary for service delivery
• Use anonymized, aggregated data for service improvement

11. Account Deletion

You may delete your account at any time through the Account screen:

• Personal information (email, name, user ID) is permanently deleted
• Payment and subscription data is removed
• Analytics data is anonymized
• Deletion cannot be undone
• Active subscriptions are canceled automatically

12. Third-Party Services

Our services integrate with third-party AI, data, and payment services. Your use of these services through our products is subject to their respective terms:

• OpenAI GPT models (FactCheck and the WhereTo AI assistant)
• Anthropic Claude models (FactCheck)
• Google Maps Platform (WhereTo)
• Apple In-App Purchases
• Google Play Billing
• Stripe (FactCheck web payments)

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We specifically disclaim any warranty regarding:

• Accuracy of AI-generated content or fact-check results
• Accuracy of location, property, environmental, or crime data
• Availability or uptime of services
• Fitness for any particular use case

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDEAS QUANTIFIED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

In no event shall our total liability exceed the amount you paid for the services in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Ideas Quantified from any claims, damages, or expenses arising from your use of the services or violation of these Terms.

16. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Any reason at our discretion

17. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be notified at least 30 days in advance. Continued use after changes constitutes acceptance of the modified Terms.

18. Governing Law

These Terms shall be governed by the laws of the United States and the State of California, without regard to conflict of law provisions.

19. Dispute Resolution

Any disputes arising from these Terms or the services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

20. Apple App Store Terms

For iOS users purchasing through the Apple App Store:

• Payment charged to your Apple ID account
• Subscriptions automatically renew unless canceled 24 hours before period end
• Manage subscriptions in Apple ID Account Settings
• Apple is not responsible for the Services or these Terms

21. Google Play Terms

For Android users purchasing through Google Play:

• Payment charged to your Google Play account
• Subscriptions automatically renew unless canceled
• Manage subscriptions in Google Play Store settings
• Google is not responsible for the Services or these Terms

22. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
